Package Holiday Claims
If injured whilst on holidays you may be entitled to pursue a personal injury action under the Package Holiday and Travel Trade Act 1995. This Act represents Ireland’s implementation of Council Directive 90/314.
What this means is that if you are injured whilst on holidays and you are a customer of a package tour operator for that holiday then you can pursue an action as against the tour operator and they can in turn pursue their own separate third party action against the negligent parties in the country where the holiday took place.
Whilst package holidays have become less popular due to customers now being able to arrange their own flights and accommodation it is still open to someone who has sustained an injury to pursue a claim.
