This is an application usually taken to the High Court by the HSE where the person involved suffers from a condition which is not recognised under the Mental Health or Wardship Law therefore necessitating that the person be taken under the care/jurisdiction of the High Court.

The solicitor in this scenario can act as a guardian ad litem for the patient in the proceedings or otherwise as the patients voice in their best interests. The issue of Capacity can cause difficulties in these cases wherein the patient may have an acquired brain injury effecting their judgement for example such as korsakoff or wet brain syndrome wherein the brain is affected by over consumption of alcohol.
